FINANCIAL CRISIS AND INSOLVENCY
Insolvency is a harsh reality, both to the creditor losing substantial amounts of money and to the party affected by it. For the trustee in insolvency, it is a business which needs to be handled in the right way in order to be efficient and profitable. Finally, for an investor, the insolvency of a target is sometimes the right moment to invest.
BRÖDERMANN & JAHN is counselling in all situations. This includes representation of trustees in insolvencies (especially in complicated corporate matters such as piercing the corporate veil, in enforcement of claims abroad and in selling foreign subsidiaries or daughter companies of the bankrupt company). Similarly, BRÖDERMANN & JAHN often advises creditors (including the development of creative solutions such as an international pooling of creditors in an international insolvency).
Finally, the BRÖDERMANN & JAHN team has experience in helping clients to avoid insolvency through financial restructuring and to use it as a tool to sell (or buy) a business unit. In Financial Crisis Cases, BRÖDERMANN & JAHN also assists the client to pool together expertise from different disciplines in order to sort out innovative and pragmatic solutions.
In 1996, together with six other lawyers, Dr. Eckart Brödermann has co-authored a book called "The Creditor in Insolvency Proceeding" ("Der Gläubiger in der Gesamtvollstreckung") summarising practical experience in insolvency cases in East-Germany from a creditors viewpoint.
BRÖDERMANN & JAHN determines the team assisting in an insolvency situation on a case-by-case basis. The composition of the team depends on the tasks involved. In the past, up to five lawyers have been integrated in more complex long-term projects, working in two teams on different set of tasks (e. g. one team coping with creditors and one team working on Corporate Finance and M&A-issues).
